If the relative is in the US on a legal status they can apply for Adjustment of Status.<\/p>\n<p>\n<\/p><p>Step 1 &#8211; Proof of qualifying relationship<\/p>\n<p style=\"text-indent: -.25in; mso-list: l0 level1 lfo1;\">1.<span style=\"font-style: normal; font-variant-numeric: normal; font-variant-east-asian: normal; font-weight: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>Submit your application and supporting documents that prove qualifying relationship and pay the government fee.<\/p>\n<p style=\"margin-left: .5in;\">If there is no waiting period because the relative is considered an immediate relative we can file for adjustment of status immediately.<\/p>\n<p style=\"text-indent: -.25in; mso-list: l0 level1 lfo1;\">2.<span style=\"font-style: normal; font-variant-numeric: normal; font-variant-east-asian: normal; font-weight: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>Receipt notice \u2013 Receipt notice will arrive acknowledging receipt of government fees and of the application.<\/p>\n<p style=\"text-indent: -.25in; mso-list: l0 level1 lfo1;\">3.<span style=\"font-style: normal; font-variant-numeric: normal; font-variant-east-asian: normal; font-weight: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>Approval Notice \u2013 The application needs to be processed by the USCIS, after the application is processed, we receive an approval notice.<\/p>\n<p style=\"text-indent: -.25in; mso-list: l0 level1 lfo1;\">4.<span style=\"font-style: normal; font-variant-numeric: normal; font-variant-east-asian: normal; font-weight: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>Waiting for file to be current \u2013 With family-based petitions, the US prioritizes different types of family relationships, and the preference classification will determine how long the beneficiary will need to wait for there to be a visa available for them. In some cases, it can take years until there is a visa available and we are able to apply for an immigrant visa.
